Membership of the Board will be determined in the following manner:

1. (a) Two members and an alternate for each member shall be selected from nominees submitted by each of the following groups designated in paragraphs (a) (1) and (2) of this section, or from among other qualified persons belonging to such groups:

   1. (1) Those growers who market their almonds through cooperative handlers; and
   2. (2) Those growers who market their almonds through other than cooperative handlers.

2. (b) Two members and an alternate for each member shall be selected from nominees submitted by each of the following groups designated in paragraphs (b) (1) and (2) of this section, or from among other qualified persons belonging to such groups:

   1. (1) Cooperative handlers; and
   2. (2) All handlers, other than cooperative handlers.

3. (c) One member and an alternate shall be selected from nominees submitted by each of the following groups designated in paragraphs (c) (1) and (2) of this section, or from among other qualified persons belonging to such groups:

   1. (1) The group of cooperative handlers or the group of handlers other than cooperative handlers, whichever received for their account more than 50 percent of the almonds delivered by all growers as determined by December 31 of the then current crop year; and
   2. (2) Those growers whose almonds were marketed through the handler group identified in paragraph (c)(1) of this section.
