43 C.F.R. § 3461.0-3 – Authority.

(a) These regulations are issued under the authority of the statutes listed in § 3400.0-3 of this title.
(b) These regulations primarily implement:
1. (1) The general unsuitability criteria in section 522(a) of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1272(a));
2. (2) The Federal lands review in section 522(b) of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1272(b)); and
3. (3) The prohibitions against mining certain lands in section 522(e) of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1272(e)).
