The unit operator must submit an application for BLM approval of a proposed participating area no later than:

1. (a) 60 days after receiving BLM's determination identified in § 3281.15(a)(3) that a unit well will produce or utilize in commercial quantities; or
2. (b) 30 days before the initiation of commercial operations, whichever occurs earlier.
