In determining if your operating performance is unacceptable, BSEE will consider, individually or collectively:

1. (a) Accidents and their nature;
2. (b) Pollution events, environmental damages and their nature;
3. (c) Incidents of noncompliance;
4. (d) Civil penalties;
5. (e) Failure to adhere to OCS lease obligations; or
6. (f) Any other relevant factors.
