Where problems not rising to the level of imminent jeopardy are caused by Tribal/Consortium action or inaction, the conditions must be:

1. (a) Documented in the Department's annual trust evaluation report;
2. (b) Reported to the Secretary; and

3. (c) Reported in writing to:

   1. (1) The governing body of the Tribe; and
   2. (2) In the case of a Consortium, to the governing body of each Tribe on whose behalf the Consortium is performing the trust PSFAs.
