The Secretary determines the amount of indirect costs for a non-BIA funding agreement by:

1. (a) Applying the negotiated indirect cost rate to the appropriate direct cost base; or
2. (b) At the Tribe's/Consortium's option, negotiating a lump sum amount for indirect costs.
