In administering any grant provided under this subpart, a Tribal college or university must:

1. (a) Provide services or assistance under this subpart in a fair and uniform manner;
2. (b) Not deny admission to any Indian student because they either are, or are not, a member of a specific Indian Tribe; and
3. (c) Comply with part 276 of this chapter, unless the BIE expressly waives specific inappropriate provisions of part 276 in response to a Tribal college or university request and justification for a waiver.
