The responsible entity must make the FONSI available for public comments for 30 days before the recipient files the RROF when:

1. (a) There is a considerable interest or controversy concerning the project;
2. (b) The proposed project is similar to other projects that normally require the preparation of an EIS; or
3. (c) The project is unique and without precedent.
