(b) This subpart does not apply to:

1. (1) Operations conducted under part 121 of this chapter in airplanes with a passenger seating configuration of more than 30 seats or a payload capacity of more than 7,500 pounds.
2. (2) Flights conducted in gliders or hot air balloons.
