This chapter does not authorize SANDAG or the department to do either of the following:

1. (a) Lease or otherwise convey a toll road to a private-sector entity.
2. (b) Convert any existing nontoll or non-user-fee highway lane into a tolled or user-fee highway lane, except in the corridor or as otherwise permitted by law.
