(a) The board shall release any levy issued pursuant to Part 10.2 (commencing with Section 18401) on any property in the event of any circumstances deemed appropriate by the board, including, but not limited to, the following:

1. (1) The expense of the sale process to the state exceeds the liability for which the levy is made.
2. (2) The Taxpayers’ Rights Advocate orders the release of the levy upon his or her finding that the levy threatens the health or welfare of the taxpayer or his or her spouse and dependents or family.
3. (3) The proceeds from the sale would not result in a reasonable reduction of the debt.
4. (4) The levy was issued not in accordance with administrative procedures.
5. (5) The taxpayer has entered into an installment payment agreement under Section 19008 to satisfy the tax liability for which the levy was made, unless that or another agreement allows for the levy.
6. (6) The release of the levy will facilitate the collection of the tax liability or will be in the best interest of the taxpayer and the state.
