The commission may do the following:

1. (a) Contract for any private professional or governmental services, if the work or services cannot be satisfactorily performed by its employees.
2. (b) Sue and be sued. The Attorney General shall represent the commission in any litigation or proceeding before any court, board, or agency of the state or federal government.
