If at such time as the plan is approved by the court the proportions above required of the stockholders, certificate holders, creditors and other persons, if any, affected thereby shall not have consented to the plan, the order of court may provide that upon satisfactory proof of the fact that such consents have been given a further order may be entered ex parte providing that such plan shall become operative, which further order shall be binding upon the commissioner, the insurer and all such stockholders, certificate holders, creditors and other persons, if any, affected thereby.
