A plan, if proposed or approved by the commissioner, shall be presented by the proposer to the superior court of the county in which the principal office of such insurer is located, with a petition that the court determine the fairness of such plan and the approvals requisite to such plan becoming operative, which petition shall set forth such plan and the fact that it has been proposed or approved by the commissioner and any other facts which such proposer shall deem material to a consideration of the fairness of the plan.
