Before a qualified individual obtains an aid-in-dying drug from the attending physician, the consulting physician shall perform all of the following:

1. (a) Examine the individual and his or her relevant medical records.
2. (b) Confirm in writing the attending physician’s diagnosis and prognosis.
3. (c) Determine that the individual has the capacity to make medical decisions, is acting voluntarily, and has made an informed decision.
4. (d) If there are indications of a mental disorder, refer the individual for a mental health specialist assessment.
5. (e) Fulfill the record documentation required under this part.
6. (f) Submit the compliance form to the attending physician.
