Violation of this article by any person, as defined in Section 109995, shall constitute an infraction, punishable by a fine not to exceed the following:

1. (a) One thousand dollars ($1,000) for the first violation.
2. (b) Two thousand dollars ($2,000) for the second violation.
3. (c) Five thousand dollars ($5,000) for the third and each subsequent violation.
