(a) An enforcement officer may enter a body art facility during the facility’s hours of operation and other reasonable times to do any of the following:

1. (1) Conduct inspections, issue citations, and secure samples, photographs, or other evidence from a body art facility, or any facility suspected of being a body art facility.
2. (2) Check the Infection Prevention and Control Plan, required pursuant to Section 119313, to determine if persons working in the facility are following the plan, and to determine if the plan is in compliance with this chapter.
3. (3) Secure as evidence documents, or copies of documents, including the Infection Prevention and Control Plan, or any record, file, paper, process, invoice, or receipt for the purpose of determining compliance with this chapter.

(d) It is a violation of this chapter for the owner or a person working in a body art facility to do any of the following:

1. (1) Conceal records or evidence, or to withhold evidence.
2. (2) Interfere with the performance of the duties of an enforcement officer.
3. (3) Make a false statement, representation, certification, record, report, or otherwise falsify information required to be submitted or maintained pursuant to this chapter.
