1. (a) The Department will no longer provide pre-employment transition services to a potentially eligible student in any of the following circumstances:

   1. (1) The individual no longer meets the definition of a student with a disability.
   2. (2) The individual has applied for and been determined eligible for the vocational rehabilitation program, as described in section 7062 of these regulations, and may receive pre-employment transition services as an eligible individual.
   3. (3) The individual has applied for and been determined ineligible for the vocational rehabilitation program, as described in section 7179.1 of these regulations.

2. (b) The Department will no longer provide pre-employment transition services to an eligible individual in any of the following circumstances:

   1. (1) The individual no longer meets the definition of a student with a disability.
   2. (2) The individual's record of services is closed pursuant to sections 7179 through 7181 of these regulations.
3. (c) The Department will not close the record of services of a potentially eligible student if they are exercising their right to appeal an ineligibility determination, as described in section 7376 of these regulations.
