(e) The Commission may perform a program review of the Institution's management of MCS funds for compliance with all applicable federal and state laws, and regulations.
(1) Where the Commission determines an Institution has failed to substantially comply with its obligations under the MCS Program statutes and Section 30801 of these regulations, appropriate corrective measures shall be prescribed to restore compliance. Such corrective measures include but are not limited to:

1. New section filed 3-21-2024; operative 3-21-2024 (Register 2024, No. 12). Pursuant to Education Code section 70023(c) and (g), this action is a deemed emergency. A Certificate of Compliance must be submitted to OAL by 9-17-2024 or the emergency language will be repealed by operation of law on the following day.
2. New section refiled 9-19-2024; operative 9-19-2024 (Register 2024, No. 38). Pursuant to Education Code section 70023(c) and (g), this action is a deemed emergency. A Certificate of Compliance must be submitted to OAL by 12-18-2024 or the emergency language will be repealed by operation of law on the following day.
3. New section refiled 12-19-2024; operative 12-19-2024 (Register 2024, No. 51). Pursuant to Education Code section 70023(c) and (g), this action is a deemed emergency. A Certificate of Compliance must be submitted to OAL by 3-19-2025 or the emergency language will be repealed by operation of law on the following day.
