1. (a) To participate, the Department shall enter into a written agreement with the U.S. Department of Agriculture to accept responsibility for the administration of child nutrition programs at the state level.

2. (b) To participate, each child nutrition entity shall enter into a written permanent single agreement with the Department to accept responsibility for operation of a school lunch and/or breakfast program.

   1. (1) Agreement forms, provided by the Department, shall be submitted by the child nutrition entity to the Department at least 30 calendar days prior to the commencement date of school lunch and/or breakfast program operations.
