1. (a) A nutritionally adequate meal is a breakfast or lunch which meets the requirements of section 49531 of the Education Code and the federal National School Lunch Act and the Child Nutrition Act.

2. (b) A pupil is determined to meet the definition of a “needy pupil” when:

   1. (1) They are eligible for free meals because their household is at or below 130 percent of the federal poverty guidelines prescribed by the Office of Management and Budget for such family size, or
   2. (2) They are eligible for reduced-price meals because their household is above 130 percent and at or below 185 percent of the federal poverty guidelines prescribed by the Office of Management and Budget for such family size.
