Definitions for Use in Protests Against the Issuance of Alcoholic Beverage Licenses.

(a) Definitions for use in Article 23 in Division 1 in Title 4 of the California Code of Regulations and Chapter 6 in Division 9 of the Business and Professions Code.
- (1) “Applicant” shall mean any person or entity who submits to the Department an application for a license.
- (2) “Department” shall mean the California Department of Alcoholic Beverage Control.
- (3) “File” shall mean to submit a document to the Department either by mail, in person, or email.
- (4) “Governing body” shall mean a tribal government, the board of supervisors of a county, or the city council of a city which has jurisdiction over the area where the premises is located.
- (5) “Local law enforcement agency” shall mean any city or county law enforcement agency which has jurisdiction for enforcement over the area where the premises is located.
- (6) “Organization” shall mean any business, non-profit, or other entity that is not an individual, governing body, or a public agency.
- (7) “Owner of real property” shall mean an individual or organization which owns any real property within a five-hundred (500) foot radius of the premises.
- (8) “Protest” shall mean an opposition to a license application or issuance of a license.
- (9) “Protest period” shall mean the period that a protestant may file their protest against an application as specified in Business and Professions Code section 24013(a), and further clarified in Title 4 California Code of Regulations sections 146.1(e) and 146.2(a), as applicable.
- (10) “Protestant” shall mean an individual, organization, public agency, or governing body that files a protest.
- (11) “Public agency” shall mean the sheriff, chief of police, district attorney, or city or county planning director, or their designee, of the locality in which the premises is located.
- (12) “Public official” shall mean an authorized representative of a governing body or public agency.
- (13) “Resident” shall mean an individual or organization which maintains their domicile at a location within a five-hundred (500) foot radius of the premises.
