1. (a) If, within the time frame found in The Act, the respondent elects to pursue a different ADR process pursuant to the parties' written contract, the Department shall cede authority to that process. The Department's jurisdiction may be restored under certain circumstances. These circumstances are set out in The Act.

   1. (1) If one of the parties believes the other is not pursuing ADR in good faith, then he or she may be able to restore Department jurisdiction. These circumstances are set out in the Act.
