1. (a) The EA shall determine if the RFI amendment(s) meet the requirements of § 21665(c) within 30 days of receipt and either accept or reject some or all of the amendment(s).

2. (b) Within 5 days of acceptance for filing of the RFI amendment application package, the EA shall notify the operator, the CIWMB and the RWQCB, if applicable, of its determination. The EA shall include in their notification to the CIWMB, a copy of the accepted RFI amendment(s), and a copy of the application form specified in § 21570 along with the EA determination specified in ¶(a).

3. (c) In cases where some or all of the amendment(s) do not follow the criteria set in § 21665(c), the EA may either require the operator to submit an application for a modified or revised solid waste facilities permit pursuant to § 21570, or deny the proposed amendment(s), in which case the applicant shall have thirty (30) days within which to appeal the decision to the hearing panel.
