1. (a) Eligibility must be determined for each recipient of a public benefit subject to this chapter.
2. (b) To be eligible to receive a public benefit subject to this chapter, a person must be a United States citizen or national, or, pursuant to Section 411 of the PRWORA, one of the following: (1) a qualified alien; (2) a nonimmigrant alien under the INA; or (3) an alien who is paroled into the United States under § 212(d)(5) of the INA (8 U.S.C. § 1182(d)(5)) for less than one year.
3. (c) An alien shall be entitled to retain a public benefit under this chapter only so long as he or she is a qualified alien.
