1. (a) Notwithstanding any other provisions of this subchapter, a manufacturer may build, prior to plan approval, one prototype of each model of a dwelling or individual dwelling room or combination thereof, he proposes to manufacture provided:

   1. (1) The manufacturer informs the inspection agency in writing that he proposes to build a prototype, submitting the proposed unit serial number and a description of his proposal, and,
   2. (2) If the description generally complies with the requirements of this subchapter and the inspection agency provides written approval to build said prototype, and,
   3. (3) Requests for inspection are to be made to the inspection agency, and
   4. (4) Where the department is the inspection agency, inspection fees as specified in Section 3061 are paid at time of inspection.
2. (b) The inspection agency, upon request, shall inspect prototypes based upon visual in-plant inspections to determine compliance with the requirements of these regulations.

3. (c) Upon completion of prototype construction and approval by the inspection agency, the manufacturer shall submit a complete plan of his prototype to the department or design approval agency for approval.

   Prototype plans shall be subject to the requirements relating to installation plans.

4. (d) Insignia shall be purchased by the manufacturer and shall be affixed to the prototype by a representative of the inspection agency, after determination that the unit complies with the requirements of these regulations.
