Facilities issued a recycled water permit1 shall be charged the amounts listed below. Facilities that produce and distribute and/or use recycled water shall pay applicable fees and surcharges for both production and distribution and/or use of recycled water. Any facility that receives a 50 percent fee discount per section 2200 footnote 2 will also receive a 50 percent discount on any applicable fees and surcharges set forth in section 2200.8.

Facilities that produce recycled water shall be charged based on the type of recycled water produced. For production facilities subject to an annual fee under section 2200, the amount will be reflected as a surcharge. For facilities not subject to an annual fee under section 2200, the amount will be billed as an annual fee.

Distribution and/or Use:
Facilities issued a recycled water permit for the distribution and/or use of recycled water shall pay an annual fee of $1,500. For facilities subject to an annual fee under section 2200, the amount will be reflected as a surcharge. For facilities not subject to an annual fee under section 2200, the amount will be billed as an annual fee.
1 For purposes of this section, the term “recycled water permit” means an order adopted by a regional water board or the State Water Board prescribing requirements for a recycled water project, including but not limited to water recycling requirements pursuant to Water Code section 13523, master recycling permits pursuant to Water Code section 13523.1, National Pollutant Discharge Elimination System permits pursuant to the Federal Water Pollution Control Act and Water Code section 13377, waste discharge requirements pursuant to Water Code section 13263, and waivers of waste discharge requirements pursuant to Water Code section 13269.
2 Facilities producing both potable and non-potable recycled water shall pay only the potable recycled water amount.
