- (a) An Applicant that is a public agency, local agency, nonprofit organization, special district, joint powers authority, tribe, public utility, local publicly owned utility, or mutual water company, is eligible for Grant funding under this Article.
- (b) An Applicant that is a mutual water company, a joint powers authority with municipal water company member(s), or a utility serving the public and regulated by the California Public Utilities Commission is only eligible for Grant funding if the Applicant's proposed Project has a public purpose and benefits customers, not investors, of the water system.
