1. (a) Except as provided in subdivision (b), the Board shall not provide a RUST Program grant to a person or entity of more than seventy thousand dollars ($70,000).

   1. (A) The project facility is a fueling station that is available for public use;
   2. (B) There is no other fueling station available for public use within a radius of 15 miles from the project facility;
   3. (C) The project tank will be removed and replaced; and
   4. (D) The project tank is required to be permanently closed pursuant to section 25292.05 of the Health and Safety Code.
   5. (2) A grant issued pursuant to paragraph (1) does not count toward the maximum grant amount set forth in subdivision (a).

   (b)(1) Notwithstanding subdivision (a), the Board may provide a grant of up to one hundred forty thousand dollars ($140,000) to an applicant for a project that meets all of the following conditions:
