Closure Denial Petitions and Closure Reviews.

- (a) Any responsible party who believes that the Corrective Action Plan for the site has been satisfactorily implemented, but the Cleanup Oversight Agency has not issued a closure letter, may petition the Board for a review of the case pursuant to section 25296.40 of the Health and Safety Code and article 6 of chapter 18 of division 3 of title 23 of the California Code of Regulations.
- (b) Regardless of whether a petition has been submitted, the Board may review any underground storage tank release case and may close that case if conditions are found to comply with all the requirements of subdivisions (a) and (b) of section 25296.10 of the Health and Safety Code and this article.
