1. (a) In order to be considered eligible for supplemental reimbursement a hospital shall be determined an eligible hospital.

2. (b) A hospital shall meet both of the following conditions in order to be determined an eligible hospital:

   1. (1) Be a disproportionate share hospital as defined in section 57006 of article 1, for the three most recent years, and
   2. (2) Have entered into a contract to provide Medi-Cal inpatient hospital services pursuant to section 14082 of the Welfare and Institutions (W&I) Code, have entered into a contract with a county organized health system pursuant to section 14087.5 of W&I or participate as a provider in a successor program.
