1. (a) A person or family applying for Medi-Cal only shall submit a completed application form to the county department.

2. (b) The county department shall, within 30 days of receipt of a referral from the Department pursuant to 50183.5, contact an ABD person in a long-term care facility and assist the ABD person with the completion of an application form for Medi-Cal-only.

   1. (1) An application for Medi-Cal-only shall be completed when:

      1. (A) The ABD person has been in long-term care for more than the month of admission and is expected to remain in the facility for at least 30 days.
      2. (B) The ABD person has nonexempt monthly gross income in excess of $44.90.
   2. (2) The county department shall advise the Department immediately that an inappropriate referral has been received when the conditions in (1) do not exist.
