1. (a) The hearing shall be conducted by an impartial official.

2. (b) The appellant shall have the opportunity to:

   1. (1) Examine, prior to and during the hearing, the documents and records presented to support the decision under appeal;
   2. (2) Question or refute any testimony or evidence, including an opportunity to cross-examine adverse witnesses;
   3. (3) Be assisted or represented by an attorney or other person, if desired;
   4. (4) Bring witnesses;
   5. (5) Advance arguments without undue interference;
   6. (6) Submit evidence to establish all pertinent facts and circumstances in the case.
