Cal. Code Regs. tit. 22, § 35367 – Information to the Parents.

(a) The agency shall inform the parents of a child with Indian heritage that:
1. (1) The provisions of the ICWA shall apply if at least one parent is a member of an Indian tribe as defined at Section 35000(i)(7) and the child is an Indian child as defined at Section 35000(i)(5).
