2. (b) The agency shall accept the mother's consent to the adoption of a newborn only after she has been medically discharged from the hospital.

   1. (1) In those cases in which the birth mother is hospitalized more than five days after the birth of the child, the agency shall accept the mother's consent only after obtaining a written statement from the attending physician that the birth mother is competent to consent to the adoption of the child.
