1. (a) The provisions of this section shall apply when either of the following conditions occur prior to the expiration of the time period specified in Section 7552:

   1. (1) The facility ceases to be a MPSC.
   2. (2) The ownership of the facility changes to a for profit owner.

2. (b) Unless a waiver pursuant to Section 7562 is obtained, the Department and the AAA in cooperation with the Department, shall take all actions allowable under the law to collect the federal reversionary interest. These actions may include, but not be limited to, any of the following:

   1. (1) Issuing a demand for the repayment of funds.
   2. (2) Commencing an investigation under the authority of Section 11180, Government Code.
   3. (3) Notifying local law enforcement.
   4. (4) Initiating court proceedings.
3. (c) The federal reversionary interest shall be determined in accordance with 42 U.S.C. 3030b.
