Collection of Filing Fees; Resubmission Period.

- (a) The definitions provided in Section 21904 shall apply to this section.
- (b) Except as permitted by subdivision (c), the Secretary of State shall not accept an eligible document for filing unless all applicable filing fees as set forth in Article 3 of Chapter 3 of Part 2 of Division 3 of Title 2 of the California Government Code have been paid to the Secretary of State. All filing fees are nonrefundable.
- (c) If an eligible document is returned without being filed for reasons (other than an insufficient filing fee) specified in a filing response, the eligible document may be resubmitted for filing within 30 calendar days following the date of the first filing response without a new filing fee (all applicable processing, special handling and/or copying fees shall continue to be required). Subsequent filing responses shall not trigger a new 30 calendar day grace period.
