- (a) Within 30 days of adoption of the decision on a test claim, or the early termination or expiration of a reasonable reimbursement methodology, the successful test claimant shall file with the Commission proposed parameters and guidelines, pursuant to Government Code section 17557(a). Proposed parameters and guidelines shall be filed in accordance with section 1181.3 of these regulations. If representations of fact are made, they shall be supported by documentary or testimonial evidence in accordance with section 1187.5 of these regulations.
- (b) If any of the elements described in section 1183.7 are missing or are not adequately addressed, Commission staff shall, within 10 days of receipt, deem the proposed parameters and guidelines incomplete and shall return the proposal to the claimants with a description of the subjects that are to be redrafted or supplemented.
- (c) Within 10 days of receipt of completed proposed parameters and guidelines, Commission staff shall issue a copy to all persons on the mailing list described in section 1181.4 of these regulations, and shall post it on the Commission's website.
- (d) Commission staff shall notify all persons on the mailing list that they shall have the opportunity to file written comments concerning the proposed parameters and guidelines within 15 days of service.
- (e) Written comments shall be filed in accordance with section 1181.3 of these regulations, and shall include a copy of relevant portions of any documents not readily available online and shall identify the specific statutes and chapters, articles, sections, regulatory registers, case law citations, and page numbers of all authorities relied upon. If representations of fact are made, they shall be supported by documentary or testimonial evidence in accordance with section 1187.5 of these regulations.
- (f) Within 15 days of service of the comments, anyone may file written rebuttals with the Commission in accordance with section 1181.3 of these regulations, which shall include a copy of relevant portions of any documents not readily available online and shall identify the specific statutes and chapters, articles, sections, regulatory registers, case law citations, and page numbers of all authorities relied upon. If representations of fact are made, they shall be supported by documentary or testimonial evidence in accordance with section 1187.5 of these regulations.
