1. (a) To be eligible for the FlexElect Program, an employee must be working half-time or more and be either:

   1. (1) a permanent civil service employee who is designated managerial, supervisory or confidential for collective bargaining purposes; or,
   2. (2) a permanent civil service or exempt employee who is serving in an agency, or part thereof, in which employees are excluded from collective bargaining by Government Code section 3513(c); or,
   3. (3) an exempt employee whose assignment has been designated managerial, supervisory or confidential by the Department for benefit purposes.
2. (b) FlexElect participation is limited to employees whose benefits are administered by the Department.
3. (c) Employees who are on an approved leave of absence with return rights to an eligible excluded class will be eligible to enroll and participate in FlexElect during the September enrollment period.
4. (d) FlexElect participants who change from excluded status to represented status during the plan year will remain in the FlexElect Program for the plan year.

Employees must be designated as an excluded employee to enroll during the annual open enrollment period.
