1. (a) Ethnic, sex and disability information shall not be used in a discriminatory manner in the selection process.

2. (b) Such information shall only be used for one or more of the following purposes:

   1. (1) research and statistical analysis to assess the fairness of the selection process in regard to ethnicity, sex, and the disabled; or
   2. (2) to provide a basis for corrective action when adverse effect is present, and
   3. (3) to evaluate the State's affirmative action programs.
