1. (a) Based on the results of an investigation, the Board may issue a notice of probable violation of the Act or this division. A notice of probable violation shall include the following:

   1. (1) Statute, regulation, or order that the respondent is alleged to have violated and a statement of the evidence upon which the allegation is based.
   2. (2) Maximum amount of the penalty the respondent is subject to under the Act and this division.
   3. (3) Amount of the penalty, if any.
   4. (4) Corrective action, if any.
   5. (5) Response options available to the respondent under section 4252.
