1. (a) For the purposes of this article, an approved testing organization shall mean any person, firm, corporation or association which conforms to all of the following:

   1. (1) Equipped or has access to facilities which are equipped to perform tests in accordance with required test procedures.
   2. (2) Employment of personnel who are qualified for testing. Evidence of such qualifications may include persons possessing registration as a Professional Engineer.

   3. (3) Approved by the State Fire Marshal. Persons, firms, corporations, or associations desiring approval as a testing organization may initiate a request and present to the State Fire Marshal evidence of their qualifications which in the judgment of the State Fire Marshal is sufficient to grant approval.

      Approval as a testing organization shall not be granted to any person, firm, corporation, or association for the purpose of conducting tests of materials or equipment manufactured, sold, or similarly processed or handled by such person, firm, corporation or association.
