1. (a) The regional center shall have the authority to relocate a consumer residing in an ICF, ICF/DD, ICF/DD-H, ICF/DD-N or SNF when:

   1. (1) The consumer or the consumer's authorized representative asks for the consumer to be moved.

   2. (2) No other agency has jurisdiction to act or an agency with jurisdiction is unable to do so in a timely manner, and the regional center has determined that:

      1. (A) The consumer is in immediate danger; or
      2. (B) The consumer's health or safety would be compromised by continued residence in the ICF, ICF/DD, ICF/DD-H, ICF/DD-N or SNF.
