1. (a) The approved Work Activity Program design shall specify the length of the program day during which consumers receive services, provided:

   1. (1) No approved design shall define a program day of less than five (5) hours, exclusive of the meal period.;
   2. (2) The program day shall not be reduced in length from what it had been in the historical period used in calculating the Work Activity Program rate, unless an exception pursuant to Welfare and Institutions Code, Section 4862, has been granted.
