1. (a) Use of a tritium neutron generator target source shall be subject to the requirements of this article except:

   1. (1) Sections 30346, 30346.6, and 30350.3 shall not apply when the:

      1. (A) Activity of the source is no more than 30 curies; and
      2. (B) Source is used in a well with a surface casing for protecting fresh water acquifers; or

   2. (2) Section 30346.6 shall not apply when the:

      1. (A) Activity of the source is greater than 30 curies; or
      2. (B) Source is used in a well without a surface casing to protect fresh water acquifers.
