1. (a) A person is exempt from the requirements for a license specified in section 30190 and sections 30191 through 30237, and from Group 3 of this subchapter, to the extent that such person receives, possesses, uses, transfers, owns, or acquires a self-luminous product containing tritium, krypton-85, or promethium-147, provided that such product was manufactured, processed, produced, or initially transferred in accordance with a specific license issued by the U.S. Nuclear Regulatory Commission pursuant to section 32.22 in title 10, Code of Federal Regulations, Part 32 (10 CFR 32). This provision shall not be construed to incorporate by reference 10 CFR 32, section 32.22.
2. (b) The exemption provided in subsection (a) does not apply to persons who manufacture or process such a product for sale or distribution.
3. (c) The exemption provided in subsection (a) does not apply to products primarily used for frivolous purposes or as toys or adornments, containing tritium, krypton-85, or promethium-147.
