1. (a) Prior to transferring environmental health and sanitation services and programs from a local health department to an agency, the following shall be met:

   1. (1) The county board of supervisors or health district board shall authorize the total environmental health and sanitation services and programs to be transferred and maintained as a single organizational unit.
   2. (2) The Director of the State Department of Health shall give written approval for the transfer.
   3. (3) The proposed agency shall have a State Department of Health approved annual program plan.
