1. (a) An approved collector's Proof of Approval remains valid for 2 years following the date of approval, provided that all of the following conditions are met:

   1. (1) The information in the approved application remains unchanged, except as specified in Section 18660.18;
   2. (2) The collector continues to meet and fulfill the requirements of this Chapter; and
   3. (3) The collector continues to operate in conformance with DTSC requirements.

2. (b) An approved dual entity or recycler's Proof of Approval remains valid for 2 years following the date of approval, provided that all of the following conditions are met:

   1. (1) The information in the approved application remains unchanged, except as specified in Section 18660.18;
   2. (2) The recycler continues to meet and fulfill the requirements of this Chapter; and
   3. (3) The recycler continues to operate in conformance with DTSC requirements and submit to inspections by DTSC.
3. (c) To renew approval, a collector, recycler, or dual entity shall reapply to CalRecycle on a biennial basis at least 90 calendar days prior to the expiration date associated with the Proof of Approval.

4. (d) If a collector, recycler, or dual entity fails to obtain CalRecycle's approval of its renewal application by the 2-year expiration date, then the following shall apply:

   1. (1) The approval is expired and invalid.
   2. (2) The collector, recycler, or dual entity shall be ineligible for all payments set forth in this Chapter.
   3. (3) The collector, recycler, or dual entity shall immediately cease using the issued unique identification number.
5. (e) An approved collector, recycler, or dual entity may withdraw their application at any time by sending an email to [email protected] and the approval shall be displayed as “inactive” on CalRecycle's website.
6. (f) Prior to April 1, 2026, application renewals shall be sent electronically through email to [email protected]. On or after April 1, 2026, application renewals shall be sent to CalRecycle's designated electronic information submittal system available from CalRecycle's website pursuant to Section 18660.7. The date of electronic information submittal will be considered the date of receipt.

1. New section filed 5-10-2004 as an emergency; operative 5-10-2004 (Register 2004, No. 20). Pursuant to Public Resources Code section 42475.2(b) a Certificate of Compliance must be transmitted to OAL by 5-10-2006 or emergency language will be repealed by operation of law on the following day.
