1. (a) If, after notice and hearing, if one is requested, the Department finds that a PRO or Independent Producer has failed to meet a requirement of this article or this chapter, the Department may, in addition to imposing any civil penalties or taking any other action authorized under the Act, take one or more of the following actions, as it deems necessary to effectuate the purposes of the Act:

   1. (1) Revoke a previously approved plan.
   2. (2) Revoke its approval of the PRO.
   3. (3) Require additional reporting relating to compliance with the requirements of this Act or this chapter that were not met.
2. (b) Pursuant to subdivision (b) of section 42056 of the Public Resources Code, five calendar days after the revocation of a previously approved plan or revocation of approval of the PRO, the trustee or escrow agent shall implement the Closure and Transfer Plan in the previously approved plan, pursuant to subdivision (f) of section 42051.1 of the Public Resources Code and as described in section 18980.8.2.
