1. (a) Matching grants are available only to public entities that demonstrate the following:

   1. (1) The site remedial action is needed to protect public health and safety and/or the environment; and
   2. (2) The ability to pay the costs of remedial action that exceed the grant amount.
2. (b) Matching grant funds may be used only for those eligible costs pursuant to Section 18904.
